A Cabin Company Co., Ltd. (the “Company”) sets forth the following terms of use (the “Terms”) for the subscription-based accommodation service it provides (the “Service”). Customers wishing to use the Service (“Applicants”) and registered members (“Members”) agree to these Terms when applying for and using the Service.
Article 1 (Application of the Terms)
- These Terms govern all rights and obligations arising between the Company and Applicants or Members with respect to the Service.
- In addition to these Terms, the Company may establish separate accommodation terms, individual rules, or other regulations (collectively, “Supplementary Rules”). Supplementary Rules constitute part of these Terms, and if any conflict arises, the Supplementary Rules shall prevail.
Article 2 (Definitions)
The following terms shall have the meanings set forth below:
- “Service”: Accommodation and reservation rights at designated cabins operated by the Company, together with related services.
- “Member”: An individual or corporation approved by the Company under Article 3.
- “Commencement Date”: The date from which a Member may begin using accommodation entitlements.
- “Billing Cycle”: A 30-day usage period starting from the date of subscription. The first payment is charged upon application, and subsequent payments are charged automatically on the same calendar day each month (if such day does not exist in a given month, billing occurs on the last day of that month).
- “Minimum Commitment Period”: Three (3) billing cycles (90 days) starting from the Commencement Date.
- “Device”: A smartphone, tablet, or personal computer required to access the Service.
- “Antisocial Forces”: Organized crime groups, their members, affiliates, or other equivalent persons.
Article 3 (Member Registration)
- Applicants shall apply for membership by providing accurate and current information and submitting identity verification documents as prescribed by the Company.
- The Company may refuse registration if it determines that:
- false information is provided,
- the applicant is underage and lacks parental consent,
- the applicant is or is related to antisocial forces,
- the applicant has violated terms of use in past services, or
- the applicant is otherwise deemed inappropriate.
- Membership is completed once the Company approves the application and notifies the applicant.
Article 4 (Service Content)
- Members are granted one (1) overnight stay entitlement for up to two (2) persons per Billing Cycle.
- Unused entitlements may be carried over up to three (3) nights maximum.
- Accommodation contracts are governed by the Company’s accommodation terms.
Article 5 (Duty to Update Registration Information)
Members must promptly notify the Company of any changes to their registration information through the method designated by the Company.
Article 6 (Account Management)
- Members shall be responsible for managing their account information and Devices.
- Members shall not transfer, lend, or allow third parties to use their account information.
- The Company assumes no liability for damages arising from theft or unauthorized use of account information.
Article 7 (Fees)
- The subscription fee is JPY 15,000 per month (tax excluded; JPY 16,500 tax included).
- The first payment is charged upon application, and subsequent payments are automatically charged on the same calendar day each month.
- Fees will not be prorated and will not be refunded upon mid-cycle cancellation.
Article 8 (Pause System)
- Members may apply for suspension of their membership in accordance with procedures specified by the Company.
- During suspension, accommodation entitlements will not be granted.
- A pause fee of JPY 500 (tax included) per month will be charged to the registered credit card.
Article 9 (Reservations and Use Rules)
- Reservations must be made through the Company’s website or designated application.
- Reservations are subject to availability; the Company does not guarantee that Members can reserve their preferred dates.
- Members must use their own Device to check in and check out.
- Members must restore the cabin to its original condition upon checkout.
- Accompanying guests are subject to limits set by the Company; children under six (6) years old are not counted toward the limit.
Article 10 (Termination)
- Members may request termination at any time; however, such termination will only take effect after completion of the minimum commitment period (upon processing of the third payment). If termination is requested within eight (8) days of subscription and no accommodation has been used, the initial payment will be fully refunded. After eight (8) days, or once accommodation has been used, fees for the minimum commitment period are non-refundable.
Article 11 (Handling upon Termination)
- All reservations scheduled for dates after the termination date will be automatically canceled.
- No refunds will be provided upon termination, except as provided in Article 10.
- Registration and account information will be deleted upon termination, and will not be restored even if re-registered.
Article 12 (Cancellation Policy for Reservations)
- Accommodation reservations may be canceled free of charge until 4:00 p.m. on the day prior to the scheduled check-in time.
- Cancellations made after 4:00 p.m. on the day prior to check-in, or in the case of a no-show, will incur a flat cancellation fee of JPY 5,500 (tax included).
- Cancellation fees will be charged to the registered credit card.
- Cancellations and other conditions related to accommodation reservations shall also be governed by the Company’s separate Accommodation Terms.
Article 13 (Measures in Case of Violation)
- If a Member violates these Terms, the Company may suspend use, terminate the membership, and/or claim damages.
- Fees already paid will not be refunded in the event of termination due to violation.
Article 14 (Suspension or Termination of Service)
- The Company may suspend service without prior notice for maintenance, natural disasters, legal changes, or other unavoidable circumstances.
- If suspension lasts more than 72 consecutive hours, subscription fees will be refunded on a prorated basis.
- If the Service is permanently terminated, Members will be notified at least three (3) months in advance, and unused fees will be refunded on a prorated basis.
Article 15 (Disclaimer)
- The Company does not guarantee that the Service will meet Members’ specific purposes.
- The Company is not liable for indirect damages or lost profits, and shall only be liable for direct and ordinary damages caused by its gross negligence or willful misconduct.
Article 16 (Notification)
- Notices to Members will be sent to the registered email address.
- Such notices shall be deemed delivered at the time of sending, regardless of whether they are opened.
Article 17 (Prohibition on Assignment)
- Members may not assign, transfer, or provide as collateral their rights or obligations under these Terms without prior written consent from the Company.
- The Company may transfer its position as service provider, including Members’ account and personal information, to a third party.
Article 18 (Personal Information)
The Company will handle personal information of Members in accordance with its Privacy Policy.
Article 19 (Consent)
- By applying for membership, Applicants are deemed to have agreed to these Terms.
- If the Applicant is a minor, consent of a legal guardian is required.
Article 20 (Amendment of Terms)
The Company may amend these Terms where reasonable. Amendments shall take effect when posted on the Company’s website.
Article 21 (Severability)
If any provision of these Terms is deemed invalid, the remaining provisions shall remain in full effect.
Article 22 (Governing Law and Jurisdiction)
These Terms shall be governed by the laws of Japan, and any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
Article 23 (Matters for Consultation)
Any matters not stipulated herein or any doubts arising from interpretation shall be resolved in good faith consultation between the Company and the Member.
